DUI DMV License Suspension

If you have been charged with a DUI, you should be aware that your driver's license is very likely to become suspended. At the time a police officer arrested you, he may have confiscated your driver's license and provided you with a temporary pink license. This pink license is valid for thirty days from the date of your arrest. At the expiration of the thirty-day period, your temporary license expires, and your driver's license is suspended. To keep your driver's license past the thirty days, you must schedule your DMV hearing within ten days of your arrest, and you must prevail at the hearing. If you do not schedule the hearing within ten days of your arrest, or you lose the hearing, your license will be suspended pending the outcome of your criminal case. So, if you have been charged with a DUI, you should hire a criminal defense attorney to represent you at the DMV hearing and to handle the criminal DUI case against you. Your DUI defense lawyer may be able to prevail at the hearing. If he prevails, he may convince the DMV to allow you to drive on a restricted license, which typically enables an individual to drive to and from work and school. This is a much better outcome than living with a suspended license.

DUI Arrest

Most DUI arrests in Orange County and across the State of California occur after an individual has been stopped for committing a traffic infraction or as a result of a stop at a DUI checkpoint. One a police officer stops a person for a traffic violation, such as speeding, running a stop sign, or driving with a broken tail light, the officer uses the stop to investigate for signs of intoxication. If the officer notices things, such as slurred speech or the odor of alcohol or marijuana, he may ask the person to perform a series of roadside sobriety tests. An individual is not required to and should not perform such tests as the results will likely be used against him by both the police officer and the prosecution. If you performed poorly on the tests, the chances are that the officer arrested you, and now you're trying to fight the DUI charges against you. If this is your situation, please contact experienced Orange County DUI Defense Attorney William Weinberg to defend you. As mentioned previously, if convicted of a DUI, there are serious consequences that you will face, so hiring a DUI defense lawyer to defend you is the best thing you can do to lessen the impact of being charged with a DUI.
